  Good News on Road Guarding Bills

 This week SF1719 and HF2008, the bills to allow trained and certified motorcyclists to road guard during motorcycle runs, passed both the Senate and House Transportation Committees. While there were questions and concerns brought up during discussion, in the end both bills passed by unanimous voice vote with no amendments. Mack Backlund, State Coordinator for ABATE of Minnesota, testified in favor before both committees and answered questions from the committee members. Mr. Backlund thanks Chairmans Gimse and Beard for hearing the bills in their respective committees and Senator Hoffman and Representative Nornes for authoring the bills. This language has a long way to go in the process before becoming law, but passage in the Senate and House Transportation Committees is a great start. **On February 27th, this bill passed the Senate Government Innovations (Rules) Committee**

 This bill creates a motorcycle road guard certificate under which a person can stop and hold traffic during a motorcycle group ride.

1) Obedience to traffic-control signal or flagger; presumptions. Permits holders of a motorcycle road guard certificate who are acting as a flagger for a motorcycle ride to stop and hold traffic, and override traffic control devices to direct motorcycle operators or other vehicles. Requires drivers to remain stopped until directed to proceed.

2)  [171.60] Motorcycle road guard certificate. Establishes a motorcycle road guard certificate program. Subd. 1. Certificate required. Restricts performing traffic control by a motorcycle road guard unless the person holds a valid motorcycle road guard certificate. Subd. 2. Certification qualifications and standards. Directs the Minnesota Motorcycle Safety Center in the Department of Public Safety to: set qualifications to obtain a certificate; create and provide a certification course; and establish vehicle and equipment standards. Sets minimum requirements, including completion of a certification course and use of a safety vest. Subd. 3. Fee. Directs the department to set a fee for the certificate based on agency costs in implementing the program. Subd. 4. Penalty. Makes violation of the section a petty misdemeanor. Subd. 5. Rulemaking. Directs the department to adopt administrative rules governing motorcycle road guard certificates, including setting the certificate fee.

3) Effective date. Except for rulemaking authority, makes the certificate program effective one year following publication of associated administrative rules.
